A Texas federal judge has ruled 10 female plaintiffs may pursue Title IX claims against Baylor University over allegations that its inadequate response to attacks by fellow students created a heightened risk of sexual assault on campus.
The women sued the university last year in a Waco U.S. district court when they were sexually assaulted by another student, but when they sought assistance from Baylor, the school discouraged them from reporting their assaults and created a harassing environment forcing them to leave campus and depriving them of a college education.
Baylor Chancellor Ken Starr resigned last year after an investigation by Philadelphia law firm Pepper Hamilton determined that school administrators did not adequately respond to accusations of several female students who alleged they were sexually assaulted by Baylor football players.
The plaintiff’s sexual assaults took place between 2004 and 2016, have sued Baylor under Title IX of the Education Amendments of 1972, which prevents discrimination in higher education institutions that receive federal funding. They are also pursuing a mix of state law claims against the school. Baylor University has denied the plaintiffs’ claims and filed a motion to dismiss the plaintiffs’ cases.
